Members


The Hutchinson Planning Commission has been designated to serve as the Hutchinson Board of Zoning Appeals.  The 9-member commission is appointed by the Mayor with the concurrence of the Governing Body.  Two (2) of the members must reside outside but within 3 miles of the city limits.  Terms are 3 years with each member eligible for appointment to 2 consecutive terms plus 1 partial term.  For a current listing of members and terms of office, email Jana McCarron.


Meetings & Attendance Policy


An attendance record of all meetings is kept.  All regular meetings of the Board of Zoning Appeals shall be open to the public except that the Board may adjourn to executive session in accordance with K.S.A. 75-4317 et seq., entitled "Open Public Meetings" if applicable. Resolution No. 2744, Section 4 (PDF), states "That members shall be required to attend not less than 75% of regular meetings."

Purpose


The Board of Zoning Appeals holds public hearings to consider appeals by persons or officers of the city, county, or any governmental agency or body affected by any decision of the officer administering the provisions of the zoning regulations.  The Board has the power to hear and decide appeals where it is alleged there is error in any order, requirement, decision, or determination made by an administrative official in the enforcement of the zoning regulations.  The Board also hears and makes rulings on requests for special use permits and variances from the zoning regulations.

Establishment Authority


Kansas Statute K.S.A. 12-759 (g) enables communities to designate the Planning Commission as the Board of Zoning Appeals.

Public Meetings


Meetings are open to the public. Anyone who requires an auxiliary aid or service for effective communication at a Board meeting (or any City program, service or activity), should email Meryl Dye, Assistant City Manager/ADA Coordinator, at 620-259-4118 (TDD - Kansas Relay Center 711), as soon as possible but no later than 48 hours before the scheduled meeting.
